Provider: K.D. Mollé Enterprises, Inc. (“KDME Inc.”)
Service: TelePort Business Phone Systems (“TelePort”)


1. Agreement to Terms

By subscribing to, using, or accessing TelePort services, you (“Client,” “You,” or “Your”) agree to be bound by these Terms of Service (“Terms”), our Privacy Policy, and any applicable Service Agreements. If you do not agree to these Terms, you must discontinue use of TelePort services immediately.


2. Service Description

TelePort is a cloud-based Voice over Internet Protocol (VoIP) business phone service provided by KDME Inc. Features may include, but are not limited to, call routing, voicemail, conferencing, SMS/MMS messaging, call recording, and integration with third-party applications. TelePort services are intended for lawful business use only.


3. Internet Service Requirements

TelePort requires:

  • A client-provided broadband internet connection with a minimum of 100 kbps upload and download speed per concurrent call.

  • A stable and reliable connection to ensure call quality.

  • Adequate internal network configuration to prioritize voice traffic (QoS).

You acknowledge that service performance depends on your internet connection. KDME Inc. is not responsible for degraded service, call quality issues, or interruptions caused by your Internet Service Provider (ISP), network congestion, Wi-Fi instability, or insufficient bandwidth.


4. Service Availability

KDME Inc. strives to maintain high availability for TelePort services but does not guarantee uninterrupted or error-free operation. Scheduled maintenance, system upgrades, emergency repairs, or other factors may cause temporary outages.


5. Acceptable Use Policy

You agree not to use TelePort services for:

  • Any unlawful, fraudulent, or abusive purposes.

  • Harassment, spamming, or unsolicited marketing without proper consent.

  • Interference with or disruption of service for other users.

  • Transmission of harmful, defamatory, or obscene material.

KDME Inc. reserves the right to suspend or terminate services without notice if you violate these terms or applicable laws.


6. Emergency Calling (E911) Limitations

TelePort supports Enhanced 911 (E911) services; however, VoIP-based 911 has limitations compared to traditional landline service, including:

  • Service may be unavailable during internet or power outages.

  • Your registered service address must be kept up-to-date for accurate location reporting to emergency responders.

  • Mobile use or relocation of TelePort devices may result in misrouting of 911 calls.

7. Billing & Payment

  • All fees are billed in advance unless otherwise stated in your Service Agreement.

  • Payments are due by the due date listed on your invoice. Late payments may result in suspension or termination of services.

  • All charges are non-refundable unless otherwise required by law.

8. Termination of Service

Either party may terminate service with 30 days’ written notice unless otherwise stated in the Service Agreement. KDME Inc. may terminate immediately for non-payment, abuse, or violations of these Terms.


9. Limitation of Liability

To the maximum extent permitted by law, KDME Inc. is not liable for:

  • Loss of revenue, profits, or business opportunities.

  • Service interruptions caused by your ISP, hardware, or network.

  • Indirect, incidental, or consequential damages, even if advised of the possibility.


10. Changes to Terms

KDME Inc. reserves the right to modify these Terms at any time. Updated Terms will be posted on our website and will be effective immediately unless otherwise stated.


11. Governing Law

These Terms are governed by and construed under the laws of the State of California, without regard to its conflict of law provisions.
